Description The Affordable Care Act (ACA) subsidies, and specifically the guaranteed-issue requirement for health insurance, opened new possibilities for addressing future medical damages in medical professional liability claims. In some cases, it could allow for the purchase of health insurance coverage to address a plaintiff’s long-term needs, thus avoiding the inflated estimates of “life care plans.” Recent efforts to pare back federal healthcare programs, including ACA subsidies, destabilizes this scenario, potentially increasing demands for large, upfront payments to cover future healthcare needs.
